Mizen Terms of Service

1. Agreement

These Terms of Service (the "Terms") form an agreement between you and Mizen concerning your access to and use of Mizen's websites, applications, support channels, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and acknowledge the Privacy Policy.

If you do not agree, do not use the Service. If you use the Service for an organization, you confirm that you have authority to bind that organization. The Service is intended for people who have reached the age of majority where they live.

2. What Mizen provides

Mizen helps household members understand and coordinate finances while preserving individual privacy choices. Depending on availability and your plan, the Service may support manual records, bank-data connections, Mine/Yours/Ours classifications, household summaries, bills, contributions, goals, decisions, notifications, exports, and an AI-assisted Advisor.

Features may be added, changed, limited, or discontinued. We will provide notice when a material change adversely affects an active paid plan, as required by law.

3. Mizen is not a financial institution or professional adviser

Mizen is not a bank, credit union, payment network, lender, investment dealer, portfolio manager, accountant, lawyer, or tax adviser. Mizen does not hold or transfer your money and does not make decisions for you.

Summaries, forecasts, classifications, and Advisor responses are informational tools. They can be incomplete, delayed, or wrong. They are not personalized financial, investment, legal, accounting, or tax advice. Review important information against your institution's records and consult a qualified professional when appropriate. You remain responsible for decisions, filings, payments, and agreements with your household partner.

4. Your account and security

You must provide accurate information, keep your sign-in methods secure, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless the law provides otherwise. Do not share passwords, authentication codes, recovery codes, or private keys.

Each person must use their own account. A household role, invitation, or payment responsibility does not authorize anyone to sign in as another person. We may suspend access where reasonably necessary to investigate fraud, security risks, legal violations, or harm to another user.

5. Household sharing and privacy choices

The Service lets each person control how eligible information is treated as Mine, Yours, or Ours and may offer more specific visibility levels. You must have authority to connect, import, enter, or share the information you provide.

Do not use Mizen to monitor, coerce, deceive, or obtain unauthorized access to another person's finances. Do not pressure another household member to disclose private information or credentials. Mizen's labels and contribution calculations are coordination tools; they do not determine legal ownership, liability, family-law rights, support obligations, or entitlement to property.

Some shared records necessarily affect both household members. The Service will identify partner-visible changes and may require confirmation. Leaving a household or changing a setting does not necessarily remove information already lawfully incorporated into a shared record.

6. Bank-data and third-party services

If you connect a financial institution, you authorize Mizen and its bank-data provider to retrieve and process the account information you select. Your institution or provider may impose separate terms. Bank data may be delayed, duplicated, reclassified, or unavailable, and you must review it before relying on it.

The Service may link to or use third-party services for identity, bank connections, hosting, payment, notifications, security, or AI. Their services are governed by their own terms and policies. Mizen is responsible for its own obligations but does not control a third party's independent service.

7. Advisor and automated features

The Advisor and other automated features may generate summaries or suggestions from information authorized for the request. They may make mistakes or omit context. You must review output before acting on it. Do not rely on the Service for emergency decisions, securities trading, tax filing, legal deadlines, or regulated professional advice.

You may not attempt to use automated features to reveal another person's private information, bypass permissions, create unlawful or harmful content, or interfere with safeguards. Mizen may block or review abusive technical activity using minimized security records.

8. Your content

You retain your rights in information and content you submit. You give Mizen a limited, non-exclusive licence to host, process, reproduce, and display that content only as needed to provide, secure, support, and improve the Service in accordance with the Privacy Policy and your permissions.

You represent that you have the right to provide the content and that doing so does not violate law or another person's rights. Do not upload malware, unlawful content, or highly sensitive information that the Service does not request.

9. Paid plans, billing, cancellation, and refunds

If you purchase a paid plan, the price, billing period, taxes, renewal terms, and any trial terms shown before checkout form part of your agreement. Payments and payment methods are handled by our payment provider. Subscriptions renew for the period shown at checkout until cancelled.

You may cancel through the billing controls made available in the Service. Unless a different date is shown or applicable law requires otherwise, cancellation stops renewal and access continues until the end of the paid period. Refunds, credits, cancellation rights, and chargeback rights are governed by the offer shown at purchase and applicable consumer law. Nothing in these Terms limits a non-waivable statutory right.

We may change prices prospectively with the notice required by law. We will not charge a new price for a renewal until required notice has been given and any required consent has been obtained.

10. Communications

You agree to receive service communications reasonably necessary to operate your account, such as security, privacy, billing, connection, and material service notices. These are not marketing messages.

We will send commercial electronic messages only with the consent or other authority required by Canada's anti-spam law. Commercial messages will identify the sender and provide a working unsubscribe method. You may withdraw consent at no cost; we will process the request within the legally required period. Unsubscribing from marketing does not stop essential service communications.

We may investigate suspected misuse and restrict access proportionately. Where reasonable, we will provide notice and an opportunity to address the issue.

12. Intellectual property

Mizen and its licensors own the Service, software, designs, documentation, trademarks, and other materials we provide, excluding your content and third-party materials. Subject to these Terms, Mizen grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose.

Feedback may be used without obligation to you, but we will not treat private financial data as product feedback or disclose it contrary to the Privacy Policy.

13. Availability and changes

We work to provide a reliable Service, but uninterrupted or error-free operation is not guaranteed. Financial institutions, data providers, networks, and other dependencies may delay or interrupt features. Maintenance, security events, or legal requirements may also affect availability.

We may update the Service and these Terms. If a change materially reduces your rights or materially increases your obligations, we will provide advance notice and seek any consent required by law. Continued use after a non-material change takes effect means you accept the revised Terms.

14. Suspension and termination

You may stop using the Service and request account deletion through the available settings or by contacting support. Cancelling a subscription, disconnecting an institution, leaving a household, and deleting an account are separate actions.

We may suspend or terminate access for a serious or repeated breach of these Terms, security risk, unlawful use, non-payment, or where required by law. We will act reasonably and respect applicable consumer rights. Provisions that by their nature must survive termination—including ownership, payment obligations already incurred, lawful retention, disclaimers, and limits of liability—continue to apply.

15. Disclaimers

To the extent permitted by law, the Service is provided on an "as available" basis. Mizen does not guarantee that imported data, classifications, calculations, forecasts, third-party data, or automated output will always be accurate, complete, current, or suitable for a particular decision.

Applicable consumer protection law may provide warranties or remedies that cannot be excluded. Nothing in these Terms excludes or limits those rights.

16. Limits of liability

To the extent permitted by law, Mizen is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, opportunities, goodwill, or data, arising from use of the Service. To the extent permitted by law, Mizen's aggregate liability arising from the Service will not exceed the greater of CAD $100 and the amount you paid Mizen during the 12 months before the event giving rise to the claim.

These limits do not apply to liability that cannot lawfully be limited, including where applicable for intentional or gross fault, bodily injury, or a violation of mandatory consumer rights. They do not require a Quebec consumer to arbitrate, waive a class action, or bring a dispute outside Quebec.

17. Governing law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. If you are a consumer, the mandatory laws and courts of your province or territory continue to apply. Quebec consumers retain every right and remedy provided by Quebec law.

Before starting a formal proceeding, please contact support@mizen.money so we can try to resolve the concern. This informal step does not shorten or waive a legal limitation period or a right to contact a regulator or court.

18. General

If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Mizen may assign them as part of a lawful reorganization or transfer, subject to applicable law. These Terms, the Privacy Policy, and the terms shown for a purchased plan are the agreement concerning the Service, unless a separate written agreement applies.

The French and English versions are intended to have the same meaning. For a Quebec consumer, the French version is provided first, and any election to contract in English must be made separately after the French version has been provided, as required by law.
